Disney won't sell the name. If they sell the name they would have to sell the whole Pirates of the Caribbean franchise.

Not necessarily true, they could license the name to a third party to run the game if they really wanted.. but they don't. The creator of Toontown (POTCO's sister project), Jesse Schell, tried to license it to keep it running but a deal was never reached.
